Living in California affords us many opportunities to enjoy water sports such as jet skiing and boating. However, the dangers of engaging in such activities are full of unique and thus unforeseen dangers. As such, legal matters involving boating accidents are complex and involve both maritime and admiral laws. Failing to adhere to such rules can result in criminal prosecution. Boat operators who do not follow the law are regarded as negligent and may be susceptible to legal action. If your boat accident occurred because of negligence on the part of the boat owner, another boat driver, or other third party, contact Genesis Law, as you may be able to file a legal claim to recover costs of financial or medical costs you have incurred. Our highly skilled attorneys will investigate, litigate, negotiate and resolve your boating accident claims.

Boating accidents can occur for a variety of reasons including, careless/reckless operation, operator inattention, inexperience, or drivers under the influence of alcohol. According to the U.S. Coast Guard, boating under the influence contributed to 17 percent of the boating accident deaths reported in 2008. Significantly, only ten percent of deaths occurred on boats where the operator had received boating safety instruction.

The Coast Guard report also indicated that:

  • The 4,789 recreational boating accidents that occurred in 2008 also involved 3,331 reported injuries and approximately $54 million dollars of damage to property.
  • More than two-thirds of all fatal boating accident victims drowned, and of those, 90 percent failed to wear a life jacket.
  • Eleven children under age of thirteen died while boating in 2008.
  • The most common types of vessels involved in reported accidents were open motorboats (43%), personal watercraft (23%), and cabin motorboats.

Do not wait to contact us at Genesis Law during this very difficult time for you or your loved one. Rest assured that we will work on your behalf to recover the remedies you deserve.
